Use of Platform: a. You must be of legal age and have the authority to enter into this Agreement. b. The Platform is provided for informational and educational purposes only and should not be considered as financial advice or a recommendation to engage in any trading activities. c. You agree to use the Platform solely for personal or internal business purposes and not for any commercial gain or redistribution.
Intellectual Property: a. The Platform and its content, including but not limited to charts, data, graphics, and software, are the intellectual property of Tesseract Pro or its licensors. b. You may not modify, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any information or content obtained from the Platform without prior written consent.
Data Accuracy and Availability: a. While Tesseract Pro endeavors to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or reliability of any data or information displayed on the Platform. b. The markets and financial instruments shown on the Platform are subject to change based on their availability. Tesseract Pro reserves the right to add, remove, or modify markets or financial instruments at any time without prior notice.
Third-Party Links: The Platform may contain links to third-party websites or resources that are not owned or controlled by Tesseract Pro. We are not responsible for the availability or content of these external sites and do not endorse any information or services provided by them.
Disclaimer of Warranty and Limitation of Liability: a. The Platform is provided on an "as-is" and "as available" basis without any warranties, express or implied. Tesseract Pro disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. b. In no event shall Tesseract Pro be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with the use of the Platform or the inability to use it.
Indemnification: You agree to indemnify, defend, and hold harmless Tesseract Pro and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of your use of the Platform or any violation of this Agreement.
Modifications to Agreement: Tesseract Pro reserves the right to modify or update this Agreement at any time without prior notice. It is your responsibility to review the Agreement periodically to ensure compliance with any changes.
Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Tesseract Pro is located. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
Software Bugs and Uptime: a. Tesseract Pro makes every effort to provide a reliable and error-free platform, but we do not guarantee the absence of software bugs or uninterrupted uptime. b. You acknowledge that the Platform may experience occasional disruptions, including but not limited to scheduled maintenance, unforeseen technical issues, or factors beyond our control. c. Tesseract Pro shall not be liable for any damages, losses, or inconvenience caused by software bugs, interruptions, or any related issues.
Force Majeure: a. Tesseract Pro shall not be liable for any failure or delay in the performance of its obligations under this Agreement due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, labor disputes, governmental actions, or any other event classified as force majeure. b. In the event of force majeure, Tesseract Pro reserves the right to suspend, delay, or terminate the Platform or any part thereof, without any liability or obligation towards you.
By using the Tesseract Pro charting platform, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions outlined in this Agreement.
